These Terms of Service ("Terms") govern your access to and use of the SPARKO AI platform and services (the "Service"), operated by SPARKO AI ("Company", "we", "us"). By creating an account or using the Service you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to use the Service. By using the Service, you represent that you meet these requirements.

2. Account

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Sparks & Payments

  • Sparks are the internal credit unit of the Service and are purchased in advance.
  • All prices are shown in US dollars (USD) and are inclusive of applicable fees unless stated otherwise.
  • Payment is processed by a third-party payment provider. We do not store full payment card details.
  • Prices may change at any time. Changes do not affect sparks already purchased.
  • Sparks do not expire while your account remains active.

4. Permitted Use

  • You may use generated images and videos for lawful commercial purposes in accordance with our license.
  • You must not upload content that infringes third-party intellectual property rights.
  • You must not use the Service to generate illegal, harmful, deceptive, or abusive content.
  • You must not attempt to reverse-engineer, scrape, or interfere with the Service.

5. Intellectual Property

You retain ownership of content you upload. You grant us a limited, non-exclusive licence to process that content solely to provide the Service. Generated output is licensed to you for commercial use, subject to any third-party model licences that may apply. We retain ownership of the Service, its software, and underlying models.

6. Disclaimers

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not warrant that the Service will be uninterrupted, error-free, or that generated output will meet your specific requirements.
  • AI-generated content may not always be accurate, suitable, or fit for purpose — you are responsible for reviewing output before use.

7. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us in the three months preceding the claim. We are not liable for any indirect, incidental, special, or consequential damages.

See our Refund Policy for details. Unused sparks may be refunded upon request in accordance with that policy.

9. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access immediately for breach of these Terms. Upon termination, your right to use the Service ceases and unused sparks may be refunded at our discretion in line with our Refund Policy.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction of the Company's registered address, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms and updating the "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance.
